These Terms of Service ("Terms") govern your use of the Driftwork AI Habit Coach app ("Driftwork," "the Service") operated by ZiggyTech Ventures LLC ("we," "us," or "our"), a Nevada limited liability company. By creating an account or using Driftwork, you agree to these Terms.

1. Use of the Service

Driftwork provides an AI-powered habit coaching experience designed to help you build habits (Forge mode) and break habits (Release mode). You may use the Service only for personal, non-commercial purposes. You agree not to:

• Misuse the Service or circumvent any security, rate-limiting, or access controls.
• Use Driftwork to generate content that is harmful, illegal, or abusive.
• Share account credentials or allow others to access your account.
• Attempt to reverse-engineer, scrape, or copy Driftwork's codebase, AI prompts, or proprietary data.

2. Not Medical Advice — AI Coaching Disclosure

Driftwork's AI coach is powered by Claude (Anthropic) and is designed to provide habit coaching support — not therapy. Specifically:

• Driftwork is not a licensed mental health provider, therapist, psychologist, or medical professional.
• Nothing in Driftwork — including AI-generated responses, habit suggestions, or coaching prompts — constitutes clinical advice, diagnosis, or treatment.
• Do not use Driftwork as a substitute for professional mental health care. If you are experiencing symptoms of a mental health condition, please seek professional help.
• Crisis resources: If you are in crisis, call or text 988 (24/7, free, confidential), or text HOME to 741741 (Crisis Text Line).

3. Subscription & Pricing

Driftwork is available on a subscription basis. Current pricing is displayed in the app. Subscriptions renew automatically unless cancelled before the renewal date. Prices are in USD and may change with advance notice.

4. Free Trial

New users may receive a free trial period with full access to Driftwork features. After the trial, continued access requires an active subscription. Trial terms (duration, feature access) are displayed in the app at signup.

5. Cancellation & Refunds

You may cancel your subscription at any time from your account settings or by contacting us. Upon cancellation, you retain access until the end of your current billing period. We generally do not offer refunds after a trial period has ended, but we reserve the right to grant exceptions at our discretion.

6. Your Data

You own your data. The habits, check-ins, and information you provide to Driftwork belong to you. We do not claim ownership of your content. See our Privacy Policy for details on collection, storage, and your rights — including Washington MHMDA rights for Washington State residents.

7. Intellectual Property

ZiggyTech Ventures LLC owns all rights to the Driftwork platform, including its software, design, AI prompt architecture, branding, and intellectual property. You may not copy, distribute, modify, publicly display, or create derivative works from any part of Driftwork without our prior written permission.

8. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that harms other users or the platform. You may cancel your account at any time from your account settings.

9. Limitation of Liability

To the fullest extent permitted by law, ZiggyTech Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Driftwork — including any outcomes related to habit change, mental health, or wellness decisions made in connection with the app. Our total aggregate liability to you shall not exceed the amount you paid us in the 12 months preceding any claim.

Driftwork is provided "as is" without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI coaching responses will always be accurate.

10. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in Nevada courts, and you consent to personal jurisdiction there.

11. Changes to These Terms

We may update these Terms from time to time. We'll notify you of material changes by email or via an in-app notice. The updated effective date will be shown at the top of this page. Continued use of Driftwork after changes take effect constitutes acceptance of the updated Terms.
